GERMANY’S NEW ASYLUM AND IMMIGRATION LAW APPROVED

On 19 December 2018, German Parliament approved new asylum (status changing) and immigration law. A German news channel NTV said that the new law will help asylum seekers to get a 30 months visa that could be after this duration converted into permanent residency. The law also helps professionals of other countries to work in Germany in shortage occupation listed jobs. 

The law mainly will help asylum seekers (asylbewerber) in Germany to finally convert their status into proper visa of 2.5 years. The so-called employment toleration law gives well-integrated, tolerated asylum seekers (Duldung status) with a job the chance to remain permanently in Germany despite their rejected asylum application. To get this status, the asylum seeker must prove the following requirements;

  • Your hold Duldung for at least a year.
  • You have been working legally at least 35 hours a week for 18 months.
  • Your identity must be unequivocally clarified.
  • There must be no criminal file.
  • You must have basic German language skills (though the exact level has not been mentioned but it might be at B1 level.
  • Your children have to go to school (if any).

If asylum seekers fulfill all of these conditions, they can apply for employment for at least 30 months, with the prospect of a permanent right of residence if that period has expired. According to Seehofer, there are currently 180,000 people in Germany who are affected by the new regulations. On the other hand, the new law also assist and supports professional of other countries to come to Germany for work just like on Canadian model of immigration (though it is not points-based). In essence, the legislature loosens the hurdles for qualified specialists from third countries who want to seek employment in Germany. So far, they may only immigrate if they have a job promise in a shortage job – for example, in the nursing sector. That should change in the future. Foreign skilled workers can then go on a job search in Germany for six months, just like university graduates. They have no entitlement to social benefits during this period. The previous practice of the priority examination is eliminated. Federal Interior Minister Horst Seehofer emphasized at the presentation of the law, although that in the search for skilled workers continue “the potential in Germany and Europe must be exhausted priority”. However, these were no longer enough.
