H-1B visas registrations for the fiscal year 2023 to start from March 1

U.S. Citizenship and Immigration Services is going to open the registration for H-1B Visa for the fiscal year 2023. The cap will open at noon Eastern on March 1 and run through noon Eastern on March 18, 2022. The interested petitioners and representatives will be able to submit an online registration through the official H-1B registration system. The final decision will be announced on 31 March.

The US issues 65,000 new H-1B visas, with another 20,000 reserved for US Masters’ degree holders every year.

Candidates can pay 10 dollars fees to apply for the registration. After the registration process is done, each candidate is issued a number for the verification process. In case the system reaches its cap and extra application have been received, a random selection system will be used to choose the successful candidates.

Application process

  • According to UCIS, the Prospective H-1B cap-subject petitioners or their representatives for applying are required to use a myUSCIS online account to register each beneficiary electronically for the selection process and pay the associated $10 H-1B registration fee for each registration submitted on behalf of each beneficiary
  • The prospective petitioners submitting their own registrations (U.S. employers and U.S. agents, collectively known as “registrants”) will use a “registrant” account. Registrants will be able to create new accounts beginning at noon Eastern on February 21.
  • Representatives may add clients to their accounts at any time, but both representatives and registrants must wait until March 1 to enter beneficiary information and submit the registration with the $10 fee.
  • Prospective petitioners or their representatives will be able to submit registrations for multiple beneficiaries in a single online session. Through the account, they will be able to prepare, edit, and store draft registrations prior to the final payment and submission of each registration.

Indians have been among the biggest beneficiaries of this visa program, receiving about 70% of the new visas issued each year.

How does the H-1B visa category work?

H-1B (specialty occupation)

Someone who wants to come to the US for a specific job that is already planned can apply for this visa.

Eligibility criteria      

To be eligible for this visa, you must have a bachelor’s or higher degree. This degree must be related to the field you will do the job in the US. 

The USCIS will finalize your eligibility that your job sets up a specialty occupation or not. Moreover, you are eligible to do that particular job or not. 

Requirements from employer

Your employer will submit:

  • A labor condition application with the commodity of labor. He/she will also regard all the rules and regulations of the agreement of the job with you. 

H-1B1 Treaty-based temporary work visa

The state allows Chile and Singapore’s residents to work on a temporary basis. This permission is due to the free commerce agreements signed with Chile and Singapore. So on this basis, the individuals who can apply for this visa are the residents of Singapore and Chile. The applicant can apply regardless of the thing that his/her partner or children have their residency in any other state. 

Requirement for the applicant

The applicants for this visa must have a particular job proposal from the US.

Requirements for the employer

Before applying for this visa, the employer will issue a labor condition application with the commodity of labor regarding all the employment rules. 

The employer will not require to do these things:

  • Submission of Form 1-129,
  • Petition for the employee,
  • Approval requirement from Form 1-797 for the applicant.
