Italy Decreto Flussi 2024 Work Visa Applying Instructions Announced

The Italian government has issued instructions for applying for the Decreto Flussi 2024 work visas. The total quota of visas has been assigned as 151,00 for the seasonal and nonseasonal visa categories. The Ministry of Labor and Social Policies provides information on submitting applications and the procedure.

Quota Distribution

The Decreto Flussi 2024 (Prime Ministerial Decree of 27 September 2023) quota distribution is as follows:

  • 700 allowances for self-employment;
  • 61,250 quotas for non-seasonal subordinate work;
  • 89,050 for seasonal subordinate work.

Applying Dates

Starting from 29 February 2024 it is possible to hire non-EU workers from abroad and convert the residence permit using the dedicated application for pre-compiling applications (Compile Applications for the Flows Decree 2024/Click-day 2024) on the ALI Services Portal of the Ministry of ‘Interno, at the address: Click here to visit.

To access the Services Portal you need a digital identity (SPID or Cie ID). The system for pre-compilation of forms is available on the following days and times:

  • 29 February to 16 March 2024 from 8.00 to 20.00;
  • 17 March 2024 from 8.00 to 18.00;
  • 19 March 2024 from 8.00 to 20.00;
  • 20 March 2024 from 8.00 to 18.00;
  • 22 March 2024 to 23 March from 8.00 to 20.00;
  • 24 March 2024 from 8.00 to 18.00.

The final requests can be sent by accessing the same web address: click here to open, from the “Fill in applications for the Decreto Flussi 2024/Click-day 2024” section, on the following days ( click day):

  • from 9:00 on 18 March 2024, applications for non-seasonal subordinate workers who are citizens of countries that have cooperation agreements with Italy can be sent;
  • from 9:00 on 21 March 2024, applications for other non-seasonal subordinate workers (including in the family and social and healthcare sectors) can be sent;
  • from 9:00 on 25 March 2024, applications for seasonal workers can be sent.

On click days, preliminary user access operations, via SPID/CIE, to the Reserved Area of the ALI Portal are permitted from 8.35 am, and from this time it will also be possible to fill in only the types of questions covered by click days. For other application models not included in the click day, the relevant pre-compilation section will be available again from the following day according to the dates and times indicated above.

Applications can be submitted until 31 December 2024, without prejudice to verification of the availability of quotas. If the application does not fall within the quota based on the chronological order of presentation, the employer will display the following notice on the ALI portal: “The application is currently not within the quota”.

Country’s List

For the entry of workers for seasonal and non-seasonal subordinate work, the countries that have signed cooperation agreements or understandings on migration matters already in force are:

Albania, Algeria, Bangladesh, Bosnia and Herzegovina, South Korea, Ivory Coast, Egypt, El Salvador, Ethiopia, Philippines, Gambia, Georgia, Ghana, Japan, Jordan, Guatemala, India, Kyrgyzstan, Kosovo, Mali, Morocco, Mauritius, Moldova, Montenegro, Niger, Nigeria, Pakistan, Peru, Republic of North Macedonia, Senegal, Serbia, Sri Lanka, Sudan, Tunisia, Ukraine.

From 1 April 2024, the Partnership Agreement on mobility and migration with India comes into force in which it is expected to reserve for 2024 a quota of 6,000 entries for non-seasonal work reasons and 4,000 for seasonal work.

Applications Forms

The templates to be used for sending only applications subject to click days for the year 2024 are as follows:

  • – C-Stag – Request for authorization/communication for seasonal subordinate work;
  • – B2020 – Authorization/communication for non-seasonal subordinate work in the sectors listed in the Prime Ministerial Decree. Flows;
  • – A-bis – Request for authorization for non-seasonal subordinate work in the family and social-healthcare sector;
  • – B – Request for authorization for subordinate work for workers of Italian origin, resident in Venezuela;
  • – VB – Application for verification of the existence of a quota for the conversion of the residence permit for seasonal work into a residence permit for subordinate work;
  • – LS – Request for the existence of a conversion quota into a residence permit for subordinate work for foreigners in possession of an EU residence permit for long-term residents;
  • – LS1 – Request for the existence of a conversion quota in a residence permit for domestic work for foreigners in possession of an EU residence permit for long-term residents;
  • – LS2 – Application for verification of the existence of a conversion quota into a residence permit for self-employed work and certification certifying possession of the requirements for self-employed work for foreigners in possession of an EU residence permit.

The application forms include the attachment, through an upload function, of the necessary evidentiary documentation which, therefore, can be examined by the One-Stop Shops for Immigration without the need to summon the applicants for the presentation of the same documentation, which will be exhibited, where necessary, in the original, upon signing the residence contract.

Application Procedure

Regarding the forwarding of requests for work authorization for the 2024 flows, the indications already provided with the interministerial circular of 27 October 2023 no. remain valid. 5969, with the clarifications provided with the current interministerial circular dated 01 March 2024 n. 1695.

The pre-compilation of applications and sending of final requests are carried out through the dedicated application on the ALI Services Portal of the Ministry of the Interior, at the address click here to open, from the “Fill in applications for the Flows Decree 2024/Click-day 2024” section.

The documentation inserted in the Reserved Area of the ALI Services Portal is transferred electronically from the aforementioned Portal to the competent Desk which examines it. There is no need to deliver another copy to the One Stop Shop for Immigration or send it via email/certified email.

If the requested documents are not available at the time of compilation, an equal number of declarations of commitment to produce the missing documentation must be uploaded; in this case, the acquisition of the documentation above is required during the preliminary investigation phase by the One-Stop Shop for Immigration, which will automatically transmit communications to the applicant/employer via the IT application (SPI 2.0). the address entered in the section of the application dedicated to pec/email delivery. For the investigation, this address must be understood as the domicile chosen by the applicant for the notification of all documents of the procedure by the One-Stop Shop for Immigration.

The applicant, having received the communication from the One Stop Shop for Immigration, can find the aforementioned communication by inserting directly into his reserved page of the ALI Services Portal the documentary additions requested (by the Prefecture or by the I.T.L.) or any observations.

In the presence of a positive opinion or, in its absence, once the deadlines for issuing the opinion have passed, the system automatically sends the authorization to the employer who displays it on the ALI portal.

In the absence of impeding reasons, the authorization, issued automatically, is also sent – electronically – to the Italian diplomatic representations of the countries of origin that will issue the entry visa.

Decreto Flussi Quota Management

The territorial distribution of the quotas for subordinate, seasonal, and non-seasonal work, including multi-year ones (including conversions) will be arranged with a specific and subsequent circular between the Territorial Labor Inspectorates, Regions, and Autonomous Provinces, by the General Directorate of Immigration and of the Integration Policies of the Ministry of Labor and Social Policies, through the SILEN computerized system, based on the needs reported at territorial level, after consultation with the social partners and, taking into account the applications received by the Prefectures’ One-Stop Shops for Immigration.

After 90 days from the effective date of the click days, if significant unused quotas are detected, they may be distributed differently by the Ministry of Labor and Social Policies based on the actual needs found on the labor market, without prejudice to the overall maximum limit.

The management of the quotas is carried out through an automatic booking mechanism for quota applications on SILEN about all procedures relating to the entry of non-EU workers for seasonal and non-seasonal subordinate work (except the quotas foreseen for the conversion of residence permits into work whose definitive commitment will be carried out by the ITL at the time of issuing the relevant opinion) which, based on the ranking (ordered according to the chronology of sending applications recorded on the click day), fall within the scope of the number of quotas envisaged at level provincial for a single model.

The definitive commitment of the quota relating to non-seasonal work will be:

  • the acquisition, within 60 days, of the positive opinion expressed on the application;
  • or when, in the absence of an opinion, the 60 days have elapsed.

The definitive commitment of the quota relating to seasonal work will be:

  • the acquisition, within 20 days, of the positive opinion expressed on the application;
  • or when, in the absence of an opinion, the 20 days have elapsed.
