The UK Home Office has published a new Statement of Changes to the Immigration Rules, introducing important updates that will affect several immigration routes, including the Graduate route, Electronic Travel Authorisations (ETAs), Student route, Skilled Worker route, and Visitor route.

The Statement was published on 9 July 2026, with most of the key changes taking effect from 3 August 2026. Applicants should also note that Home Office guidance linked to these changes may not be published until on or after the date the new rules come into force.

Graduate Route: UK-Born Babies Can Apply as Dependants

One of the most important changes concerns the Graduate route. Under the current rules, the Graduate route only allows dependents who are already existing Student dependants. This has created a problem for families where a baby is born in the UK after the parent has already moved onto, or holds, Graduate route permission.

At present, a baby born in the UK to a Graduate route visa holder is not eligible to apply as that person’s dependant under the Graduate route.

From 3 August 2026, this will change. Babies born in the UK to a parent who holds Graduate route permission will be able to make an immigration application as a Graduate dependant.

However, there is an important condition: the application must still be made inside the UK. This means the new rule applies only where the child is born in the UK and the dependent application is submitted from within the country.

This change will provide more clarity and relief for Graduate route visa holders who have children born in the UK during their period of stay.

Electronic Travel Authorisations

The Home Office is also making changes to the rules on Electronic Travel Authorisations, commonly known as ETAs.

For applications made on or after 3 August 2026, an ETA applicant may be refused if they have been convicted of a criminal offence in the UK or overseas and received a suspended sentence of 12 months or more.

The rule will also apply to people who already hold an ETA. In such cases, the ETA may be cancelled if the person falls within this criminality ground.

This means ETA applicants must be more careful when assessing whether previous criminal convictions, including those from outside the UK, may affect their eligibility.

Immigration Bail

The Statement of Changes also updates the suitability rules for people who are on immigration bail in the UK.

Some immigration routes currently state that a person cannot apply under that route while they are on immigration bail. This includes routes such as the Student route.

From 3 August 2026, the suitability requirements of several routes will allow applications from individuals on immigration bail, but only where they fall under specific exceptions for overstayers in Part Suitability, paragraph SUI 13.1.

The affected routes include:

  • Graduate route and dependants
  • Skilled Worker route
  • Visitor route

The Home Office has noted that this list is not exhaustive, meaning other routes may also be affected depending on the wording of the updated rules.

Although the Statement of Changes has already been published, the detailed Home Office guidance may not be available until on or after the effective date of the changes.

Applicants, students, workers, and families affected by these changes should make sure they check the latest official guidance before submitting an application. Immigration rules can be highly technical, and the timing of an application may make a major difference to the outcome.
