Italy’s ‘Decreto Flussi 2020’ Opening Dates for seasonal and work visa

When will the Decreto Flussi start in 2020?

The decreto flussi 2020 dates have been announced by the ministry of interior Italy. This has also been published on 12 October 2020 in the Official Journal (G.U. General Series, no. 252, of 12 October 2020).

The maximum quota of subordinate non-EU workers, seasonal and non-seasonal, and self-employed workers who will be able to enter Italy this year is 30,850.

Applications can be sent from 9 am on 27 October next.

Pre-compilation of application forms and the deadline for sending

From 9 am tomorrow 13 October 2020, the application for pre-filling the application forms will be available, by accessing the dedicated IT procedure on the website https://nullaostalavoro.dlci.interno.it, which can only be accessed with SPID credentials. Applications can be submitted until 31 December 2020.

Eligible countries for seasonal visas

The following non-EU countries’ candidates are eligible to apply under decreto flussi (seasonal visas) of 2020:

Decreto Flussi 2020 Quota

1- Seasonal Visas

The quotas will be divided between the regions and the autonomous provinces, by the Ministry of Labor and Social Policies. 18,000 fees for seasonal employment in the agricultural and tourist-hotel sectors. As part of this quota, by way of experimentation, 6,000 units are reserved for workers from the same countries, the requests of which will be presented, in the name and on behalf of the employers, by the following organizations: Cia, Coldiretti, Confagricoltura, Copagri, Alliance of cooperatives (includes Lega cooperatives and Confcooperative). Whereas 1,000 of the 18,000 quotas are reserved for entrances for multi-year seasonal work.

2- Nonseasonal visas

12.850 entries for nonseasonal, self-employed employment and conversions. Within this quota, 6,000 entries are reserved for non-seasonal subordinate work in the sectors of freight transport for third parties, construction and tourism-hotel of citizens of Albania, Algeria, Bangladesh, Bosnia-Herzegovina, Korea (Republic Korea), Ivory Coast, Egypt, El Salvador, Ethiopia, Philippines, Gambia, Ghana, Japan, India, Kosovo, Mali, Morocco, Mauritius, Moldova, Montenegro, Niger, Nigeria, Pakistan, Republic of North Macedonia, Senegal, Serbia, Sri Lanka, Sudan, Tunisia, Ukraine, and the countries that during the year 2020 have to stipulate cooperation agreements in the migration field.

The remaining shares are divided between entries of non-EU citizens who have completed training and education programs in their countries of origin, entries of workers of Italian origin residing in Venezuela, and entries of non-EU citizens for self-employment, as well as between conversions of residence permits already held for other reasons in residence permits for subordinate work and self-employment.

The relative requests can be sent starting from 9 am on 22 October.

Detailed quota distribution of non-seasonal visas

There has been set aside distribution of quota among different types of non-seasonal work visas.

Out of 12,850, a total of 6,150 visas are reserved for those who must convert the residence permit already held for another reason into work. This quota of 6,150 has further division as follows:

  • There have been reserved 4,060 visas for those with a residence permit for seasonal work to be converted into a residence permit for non-seasonal subordinate work.
  • 1,500 visas have been reserved for those with a residence permit for study, internship, and/or professional training to be converted into a residence permit for subordinate work.
  • Those with a residence permit for study, internship, and/or professional training to be converted into a residence permit for self-employment will be having a quota of 370.
  • Candidates who have an EC residence permit for long-term residents issued not by Italy but by another Member State of the European Union to be converted into a residence permit for subordinate work are given a quota of 200.
  • Those who have an EC long-term residence permit issued by another EU Member State to be converted into a residence permit for self-employment have been given a quota of 20.

Furthermore, out of a total of 12,850, a total of 6,700 foreign workers will be admitted to Italy for non-seasonal subordinate work and self-employment. This quota has also had specific division as follows:

  • A total of 6,000 visas are reserved for recruitment in the road transport, construction, and tourism-hotel sectors. 4,500 out of it are reserved for the aforementioned countries. Whereas 1,500 has been reserved for the citizens of other countries with whom cooperation agreements on migration will enter into force during the year 2020.
  • For foreign workers who have completed training and education programs in the countries of origin pursuant to art. 23 of the legislative decree 25 July 1998, n. 286 will be able to use a quota of 100.
  • 100 visas have been reserved for foreign workers of Italian origin for at least one of the parents up to the third degree of the direct line of ancestry, residing in Venezuela.
  • 500 self-employed workers will be allowed to come as well under this category.

Important note: According to the circular issued on 8 October 2020 for the road transport sector for third parties, the application for a permit for subordinate work is only allowed in favor of driver workers, equipped with professional licenses equivalent to CE category licenses, citizens of countries that issue driving licenses equivalent to the CE category and convertible in Italy on the basis of existing reciprocity agreements. These agreements are with Sri Lanka, Algeria, Moldova, Morocco, Republic of North Macedonia, Tunisia, and Ukraine.

Decreto Flussi 2020 background efforts and details

Italy does need seasonal workers for its agricultural department to sustain. To explain the terrible situation in the agricultural sector, Romano Magrini, the national work manager of Coldiretti demands the decreto flussi again. A similar warning was given before the summer, but thanks to the arrival of seasonal workers from the east, the summer products were able to profit from the production companies.
Now, however, according to Magrini, with the partial success of the regularizations in agriculture, the lack of the flow decree, and the expiration of residence permits for workers (from the East), there is a risk of getting water in the throat and without labor”.
The old amnesty was important but not sufficient to cover the real needs. The amnesty was fundamental to save at the last minute, not only the Italian economy but also the fate of over 29,000 people who deserved recognition.
All this considering that of this many of them foreigners, for the most part, were not irregular but foreigners who had received the recognition of the residence permit for asylum seekers waiting for the territorial commission to decide whether the application for the residence permit was positive or negative.
According to the Coldiretti work manager, however, the current amnesty ” did not bring a great contribution. We have always said that he would not bring it, compared to the need for work that exists on farms ‘.

“The official data – underlines the manager Coldiretti – speak of more than 207,000 illegal immigrants healed. Of these, over 176,000 are for domestic work and about 30,000 have been regularized in subordinate employment in agriculture. Of these, a thousand are from fishing “.

The Decreto Flussi 2020 will include the following:

non-seasonal subordinate workers who have completed training programs in the country of origin,
non-seasonal subordinate workers of Italian origin, residing in Argentina, Venezuela, Uruguay, Brazil, up to the third degree of ancestry in a straight line.

In addition, there are quotas for the conversion

  • seasonal residence permit, subordinate residence permit for business reasons,
  • the permit for training, study or internship, in residence permit for subordinate work,
  • permits for training, internship, and study in residence permit for self-employment,
  • long-term EC residence permits issued by another European Union country, in an Italian subordinate work residence permit,
  • to transform the long-term residence permit Ce into an Italian residence permit for self-employment.

For all further detailed information, it is important to wait for the publication of the 2020 Decreto Flussi and the explanatory circular of the Ministry of the Interior on the official journal.

The general quota for Decreto Flussi

A total of 30,850 foreigners can apply for seasonal and non-seasonal visas normally for Decreto Flussi. Out of the total, 18,000 is set aside for the seasonal workers for agricultural and tourism jobs.

On the other hand, 12,500 is for no-seasonal workers with the following distribution:

Work Visa (lavoro subordinato) Conversions into Residence Permit (permessi di soggiorno)

  • 4,750 residence permits for seasonal work;
  • 3,500 residence permits for study, training, and/or professional training;
  • 800 EU residence permits for long-term residents issued to third-country nationals from another EU Member State.

New Visas

  • 500 non-EU foreign nationals residing abroad, who have completed training and education programs in their countries of origin (pursuant to Article 23 of the Legislative Decree of 25 July 1998, No. 286;
  • 100 workers of Italian origin on the part of at least one of the parents up to the third degree in direct line of descent, residing in Argentina, Uruguay, Venezuela, and Brazil.

Conversion of Self-Employment into Residence Permit

  • 700 residence permits for study, training, and/or professional training;
  • 100 EU residence permits for long-term residents, issued to third-country nationals from another EU Member State.

New Self-Employment Visas

A total of 2400 self-employment visas are set aside normally.

WHAT IS MEANT BY DECRETO FLUSSI?

It is an immigration flow program that helps Italy to recruit non-European workers for its seasonal and non-seasonal work visas. The most famous is the seasonal visa of Italy for agricultural and tourist activities.

APPLICATION REQUIREMENTS

There are no set aside requirements for seasonal visas of Italy. Even Italian language proficiency does come into force or hurdle. There is also no set aside parameters for educational qualification as it is agricultural work so it does not matter if you have a Bachelor’s degree or a diploma. For non- seasonal visas, there are certain requirements one has to fulfill before applying.

HOW TO APPLY FOR SEASONAL WORK VISA
If you are a national of one of the above-mentioned countries, you will need a job offer from an Italian agricultural company or an employer. Once deals are done between you and your employer, the employer will submit the application for work visa permission at the interior ministry official. Once he receives the decision, he will forward it to you to represent it with your personal documents in the embassy of Italy in your country of origin. Upon receiving the work visa decision and your personal documents, the embassy will stamp you the work visa of 9 months of maximum for the purpose of agricultural or touristic work in Italy.

What is the SPID?

SPID is the access system that allows you to use the online services of the Public Administration and accredited private individuals with a unique digital identity. If you already have a digital identity, log in with your manager’s credentials. If you don’t have a digital identity yet, request it from one of the managers.

For creating a SPID from abroad, you need:

  • an e-mail address
  • the phone number of the mobile phone you normally use
  • a valid Italian identity document (one of identity card, passport, driving license)
  • your income tax number

How to get SPID?

To get SPID, choose one of the Identity Providers and register on their site. The registration consists of 3 steps:

  • Enter your personal data
  • Create your SPID credentials
  • Carry out the recognition of your choice between: in person, online, or via CIE, CNS, or digital signature.
